I posted an article earlier about workers rights and I used an example of a temporary worker losing their unemployment rights. I was surprised that some people felt that Temporary workers should not have the same rights as permanent employees, such as access to unemployment or health benefits or retirement. I was shocked that we have gone so far in this day and age to reduce the level of discrimination in the work place based on sex, race, age or handicap to take a step back and say that temporary workers are not equal and do not deserve to be treated as such. Granted a temp cannot expect to receive retirement, medical benefits, disability, workers comp or unemployment from a company they are temping at. The temp agency is their employer and should pay for those benefits. However, a temporary is expected to follow the companies polices, so should the company extend the same legal rights as their permanent employees, such as in the case of sexual harassment. discrimination, & so forth

These are federal labor laws and apply to all individuals working at any given employer. Now if you are referring to say a promotion of a individual who's a regular employee over a temp, that is not Discrimination. Its simply promoting within their own organization. Temps and Temp agencies serve a purpose, and sometimes temps become full time regular members of the companies they work for. If you work for a temp agency and feel that the work or situation is not to your liking, move on. Or, try real hard to become a intergrated member of the company where you are working and with luck you will get picked up by them from the temp agency. Realize at times this take months, in Michigan its normally 6, otherwise the hiring company has to pay the temp agency for hiring you away. Get educated on your locale situation and state laws, any contracts you signed and work from there. Good luck
